Terms and Conditions of Use Baby Room

All information used to describe the PRODUCTS and/or SERVICES available on the SITE (static/dynamic images/multimedia presentations/etc.) does not represent a contractual obligation on the part of Camera Bebelusului, being used exclusively for presentation purposes.

The promotions/offers present on the SITE are valid for a certain period of time and within the limit of available stock.

Access to place an ORDER is allowed to any CUSTOMER/USER.

For justified reasons , Camera Bebelusului reserves the right to restrict the CLIENT/USER's access to place an ORDER and/or to some of the accepted payment methods, if it considers that based on the CLIENT/USER's conduct or activity on the SITE, his/her actions could in any way harm Camera Bebelusului. In any of these cases, the CLIENT/USER may contact the Customer Support Department of Camera Bebelusului, to be informed of the reasons that led to the application of the above-mentioned measures.

By placing an ORDER on the SITE , the CUSTOMER agrees to the form of communication (telephone or e-mail) through which Camera Bebelusului carries out its operations on the SITE.

The Baby Room does not at any time consider an ORDER not confirmed by the Baby Room to have the value of a CONTRACT.

The notification received by the CUSTOMER immediately after placing the ORDER is for information purposes only and does not constitute confirmation of the ORDER. This notification is made electronically (e-mail) or by telephone.

For justified reasons , Camera Bebelusului reserves the right to change the quantity of PRODUCTS and/or SERVICES in the ORDER. If we change the quantity of PRODUCTS and/or SERVICES in the ORDER, we will notify the CUSTOMER at the e-mail address or telephone number provided to Camera Bebelusului when placing the ORDER and we will return the amount paid.

The CONTRACT is considered concluded between Camera Bebelusului and the CUSTOMER upon receipt by the CUSTOMER from Camera Bebelusului, via e-mail and/or SMS, of the ORDER confirmation notification. Therefore, the CONTRACT enters into force upon confirmation of the ORDER by Camera Bebelusului.

For ORDERS to be picked up from the Camera Bebelusului store, the prices and reservations of PRODUCTS and/or SERVICES are valid 72 (seventy-two) hours from the registration of the ORDER by the CUSTOMER.

The document and information made available by Camera Bebelusului on the SITE will form the basis of the CONTRACT thus concluded, supplemented by the Warranty Certificate issued by Camera Bebelusului's suppliers.

The terms and conditions of use may be modified at any time by updating this SITE, these modifications becoming mandatory and with immediate effect for all USERS/CLIENTS.

Command

THE CUSTOMER/USER can place ORDERS on the SITE , by adding the desired PRODUCTS and/or SERVICES to the shopping cart, and then finalize the ORDER by making the payment through one of the methods expressly indicated. Once added to the shopping cart, a PRODUCT and/or a SERVICE is available for purchase to the extent that there is stock available for it. Adding a PRODUCT/SERVICE to the shopping cart, in the absence of completing the ORDER, does not entail the registration of the ORDER, nor the automatic reservation of the PRODUCT/SERVICE.

Important announcement

Products brought on an order basis (status: pre-order) or made to order/status: pre-order (not in stock according to customer specifications) CANNOT BE RETURNED . For these products, a minimum 30% deposit is required.

The "Pre-order" status represents the status of a product or group of products for which the customer has the opportunity to place an order for that good or group of products, which is not in our company's stock and is brought specifically for it following the order placed on the website, by phone or via WhatsApp.

When receiving your order from the courier , please check the integrity of the package and check very carefully that the packaging has not been damaged!

If you notice minor damage, bent corners or edges, or a damaged or cracked product, please note on the AWB or the courier's MINUTE "PACKAGING DAMAGED DURING TRANSPORT & DEFECTIVE PRODUCT".

Sign the AWB for receipt only after you have made these observations on the AWB or the Minutes!

By completing the ORDER , the CUSTOMER agrees that all data provided by him, necessary for the online purchase process, are correct, complete and true at the date of placing the ORDER.

By completing the ORDER , the CUSTOMER consents that Camera Bebelusului may contact him, by any means available/agreed upon by Camera Bebelusului, in any situation in which it is necessary to contact the CUSTOMER.

Camera Bebelusului may cancel the ORDER placed by the CUSTOMER, following prior notification to the CUSTOMER, without any subsequent obligation of either party to the other or without either party being able to claim damages from the other in the following cases:

Price of products and services

All prices for PRODUCTS and/or SERVICES presented on the SITE are expressed in lei (RON) and include VAT.

Under the conditions provided by law, the price of electronic PRODUCTS displayed on the SITE includes the Green Stamp Tax.

In the case of online payments, CameraBebelusului is not/cannot be held responsible for any additional costs incurred by the CLIENT, including but not limited to currency conversion fees applied by the bank issuing the card, if the card's issuing currency differs from RON. The responsibility for this action lies solely with the CLIENT.

The price may be modified by the Baby Room at any time, without notice.

Camera Bebelusului warns that there are cases when, as a result of SITE malfunctions or errors, the price displayed on the SITE may not be the actual one. In these cases, Camera Bebelusului will inform the CUSTOMER of the correct price.

The prices of the PRODUCTS on the SITE are not valid for the AnneBebe / Camera Bebelusului store network.

We inform you that camabebelusului.ro reserves the right to cancel Orders for Products and Services that are displayed on the site as a result of technical errors, or which, due to technical errors, present obviously erroneous/ridiculous prices for the products (prices that any buyer may consider to be erroneous/ridiculous).

Transfer of Ownership of Products

Unless otherwise agreed by Camera Bebelusului and the CUSTOMER, ownership of the PRODUCTS will be transferred upon delivery, after payment by the CUSTOMER at the location indicated in the ORDER (meaning delivery - signing the receipt of the transport document provided by the Courier or signing the receipt on the tax invoice in the case of deliveries made in the Camera Bebelusului store).

The entire content of this site (data, images, texts, graphics, symbols, web graphics, scripts, programs and other data) is the property of ARTCONFEX SRL and is protected by copyright law, all rights being reserved. The use of any of the elements listed above without obtaining prior consent from the rights holders is punishable under the laws in force. The content of the site www.camerabebelusului.ro may not be reproduced, modified, transferred, distributed, republished, copied or transmitted in any form, including electronic form, without the prior written permission of the representatives.

Any attempt to access another user's personal data, to modify the content of the website www.camerabebelusului.ro or to affect the performance of the server on which the SC ARTCONFEX SRL website runs, will be considered an attempt to defraud the SC ARTCONFEX SRL computer systems and will result in criminal investigation against the person or persons who attempt/have attempted this.

The products sold by www.camerabebelusului.ro are new, in the manufacturer's original packaging and are accompanied by the tax invoice at the time of delivery/handover.

GUARANTEES

Commercial guarantee:

The commercial warranty is according to the warranty certificate issued by the manufacturer, depending on the product category, and represents the period during which the consumer benefits from free repairs from the seller/manufacturer.

For products purchased from the online store www.camerabebelusului.ro, a warranty is provided in accordance with the Warranty Certificate for each product or the legal warranty of conformity for 24 months from purchase. If you encounter problems with your order or the items ordered, you can contact us at office@annebebe.ro .

To benefit from the guarantee

• The product must have been purchased from SC ARTCONFEX SRL and used only for the purpose for which it was designed.
• Follow the instructions for use and use the product according to the manufacturer's instructions.
• Keep the warranty certificate and the tax document with which you purchased the product.

The place of presentation in order to benefit from the warranty is the Camera Bebelusului Showroom - Str. Mămulari No. 6, 1st Floor, behind the Unirea Shopping Center store - Above-ground Parking area, Bucharest, Sector 3. Unless otherwise specified, the cost of transportation is borne by the Customer.

Reasons for loss of warranty:

• Mechanical damage or failure; excessive exposure to solar radiation; lack of or modification of the device serial number; product modifications.
• Failure caused by failure to comply with the instructions for use, transport, handling and installation.

No guarantees are offered to Customers in the following cases:

• If the purchased product does not meet the requirements or expectations of the Customers.
• After the expiration of the period for which the Seller provides a warranty for the product.

All other provisions contained in the legislation in force, regarding the guarantee of the products sold, are valid. The rights of the Customers are those provided for in the legislation in the field. The guarantee does not extend to any damages caused by the use of the product.

Your warranty claims are limited to the possibilities of eliminating defects under post-delivery conditions.

SC ARTCONFEX SRL does not guarantee and cannot be held responsible for products that are not imported by our company, if the delivered products do not correspond to the purpose for which they were purchased. The products (when applicable) are accompanied by warranty certificates from the respective manufacturers. Any complaint will be brought to our attention, in writing, to our address office@annebebe.ro , within a maximum of 48 hours from receipt of the products, which will be transmitted to the supplier of the respective products.

Guarantee of conformity

All products benefit, according to the law, from the guarantee of conformity which represents the legal period of 2 years during which the consumer can bring the product into conformity free of charge. Conformity refers to the product characteristics offered to the consumer through the related advertising made by the seller/manufacturer.

In the case of the conformity guarantee period, the manufacturer repairs, replaces or refunds the value of the product, according to law 449/2003, Art 11, Paragraph 2. The established time period for remedying the repair cannot exceed 15 calendar days from the date on which the buyer informed the seller of the lack of conformity of the product.

Notification of faults:

You are obliged to notify SC ARTCONFEX SRL immediately and without delay of any damage noticed, especially damage caused during transport.

Payment and retention of ownership of the goods:

Until the order is paid in full, this merchandise remains the property of SC ARTCONFEX SRL.

responsibility

SC ARTCONFEX SRL is only responsible for damages that were not caused intentionally or through negligence during transportation.

SC ARTCONFEX SRL is not responsible for indirect damages.

Violation of our general conditions:

By violating our general conditions, SC ARTCONFEX SRL reserves the right to stop delivering to the customer and to terminate the contract with him.

Modification of general conditions:

SC ARTCONFEX SRL reserves the right to modify these general conditions, without giving reasons, whenever it deems it necessary. The modifications made do not apply to ongoing orders. By placing an order, the general conditions in force are automatically accepted.

Problems not resolved amicably by the parties are within the jurisdiction of the common law courts in Romania.

Law No. 449/2003

Art. 19. - The guarantee is legally binding for the bidder, under the conditions specified in the statements relating to the guarantee and in the related advertising.

Art. 20. - (1) The guarantee must include mentions of the rights conferred by law on the consumer and clearly state that these rights are not affected by the guarantee offered.

(2) The warranty must specify the product identification elements, the warranty period, the average duration of use, the methods of ensuring the warranty - maintenance, repair, replacement and the deadline for their implementation, including the name and address of the seller and the specialized service unit.

(3) The guarantee must be drafted in simple and easily understandable terms.

Art. 21. - (1) At the consumer's request, the guarantee shall be offered in writing or on any other durable medium, available and accessible to him.

(2) If the guarantee does not comply with the provisions of paragraph (1) and of art. 20, its validity is not affected, the consumer having the right to request the seller to fulfill the conditions included in the statements relating to the guarantee.

Art. 22. - (1) Contractual clauses or agreements concluded between the seller and the consumer before the lack of conformity is known by the consumer and communicated to the seller, which limit or remove, directly or indirectly, the consumer's rights provided for by this law, are null and void.

(2) In the case of used products, the consumer and the seller may agree to reduce the term provided for in art. 16, but not less than one year from the date of delivery of the product.

Our store complies with the legal guarantee of conformity.

Right of Withdrawal

According to the legislation in force, the CUSTOMER may exercise his right to withdraw from the CONTRACT within 14 (fourteen) CALENDAR days from taking possession of the PRODUCTS.

If the CUSTOMER requests withdrawal from the CONTRACT within the legal term, if the ORDER is paid, Camera Bebelusului will refund the amount within a maximum of 14 (fourteen) CALENDAR days from the date the CUSTOMER informs the Camera Bebelusului store of his decision to withdraw from the CONTRACT.

The amount will be refunded for ORDERS paid with OP / Cash on Delivery / Bank card -> ONLY by bank transfer.

For orders that were paid in full or in part with a gift card / gift voucher, the money cannot be refunded, the Voucher / Gift Card will be reissued and can be used within a maximum of 6 months from the date of first issuance.

The CameraBebelusului.ro store may postpone the reimbursement of the amount until receipt of the PRODUCTS sold or until receipt of proof that they have been shipped, if it has not offered to recover the PRODUCTS itself (the most recent date will be taken).

The CameraBebelusului.ro store reserves the right to reduce the amounts refunded to the CUSTOMER by the value resulting from the handling of the PRODUCTS, other than those necessary to determine the nature, characteristics and functionality of the PRODUCTS.

The following are exempt from the right of withdrawal from the CONTRACT:

• Service contracts, after the complete provision of the services, if the execution began with the express prior consent of the CUSTOMER and after he confirmed that he was aware of the fact that he will lose his right to withdrawal after the complete execution of the CONTRACT by the CameraBebelusului.ro Store or its suppliers.
• Supply of PRODUCTS ORDERED BY THE CUSTOMER or MADE according to the specifications presented by the CUSTOMER or clearly customized.
• Providing PRODUCTS that are likely to deteriorate or expire quickly.
• Supply of sealed PRODUCTS that cannot be returned for health protection or hygiene reasons and that have been unsealed by the consumer, according to Emergency Ordinance no. 34/2014 on consumer rights in contracts concluded with professionals, Article 16, point e). The products that fall into this category are: Underwear, Leggings, Tights, Socks, Mattresses, Bed Protectors, Bed Linen, Towels, Cloth Diapers, Sanitary Napkins, Bodysuits, Maternity Sets and all their derivatives, in order to ensure the safety and hygiene of the products sold, avoiding the risk of contamination of items intended for babies.
• Contracts where the CUSTOMER has specifically requested the CameraBebelusului.ro Store or its suppliers to travel to his home to carry out urgent repair or maintenance work. If, on the occasion of such a visit, CameraBebelusului.ro or its suppliers provide other services than those expressly requested by the CUSTOMER or provide other PRODUCTS than the spare parts indispensable for carrying out the maintenance or repair work, the right of withdrawal applies to those additional SERVICES or PRODUCTS.

If the customer receives the order, removes the product from the original box and damages the original packaging and the product, the ordered products will NOT be able to be returned!

If the customer returns the order, they will ensure that it arrives with the product packaging undamaged, so that it can be resold! Otherwise, the product return will not be accepted!

In the event of a return, the customer requesting the return of the product will ensure that the product has all accessories, has all original elements and that it has no scratches, deformations or damage following unpacking. SC ARTCONFEX SRL does not accept returns of products that are not in their original intact packaging and/or with labels, plastics or other missing elements.

Products that show signs of wear, use, or damage cannot be returned!

Products without the original factory labels attached will not be able to be returned!

For products delivered with the security tag/seal mounted upon delivery, which are returned with the security seal/tag detached/broken by the customer, no return/exchange is accepted, and after inspection the products will be delivered to the customer at their expense at an additional cost of 45 lei (round trip).

According to Emergency Ordinance No. 34/2014 on consumer rights in distance contracts: The consumer has the right to withdraw from the distance contract, without having to justify the decision to withdraw and without incurring any costs other than those provided for in art. 13 para. (3) and art. 14 of OUG No. 34/2014, within 14 calendar days from the day on which he takes physical possession of the product. The return costs are borne by you.

The returned product must be in the same condition in which it was delivered with all accessories.

For hygiene reasons, SC ARTCONFEX SRL does not accept returns for unsealed products that may endanger the lives of babies. Products that cannot be returned for health protection reasons or for hygiene reasons and that have been unsealed by the consumer are exempt from the right of withdrawal, according to Emergency Ordinance no. 34/2014 on consumer rights in contracts concluded with professionals, Article 16, point e). The products that are part of this category are: Underwear, Leggings, Tights, Socks, Mattresses, Bed Protectors, Bed Linen, Towels, Cloths, Muslin, Sanitary Napkins, Bodysuits, Maternity Sets and all their derivatives, in order to ensure the safety and hygiene of the products sold, avoiding the risk of contamination of items intended for babies.

Products Personalized with Texts or Illustrations (e.g., baptism products that are personalized with the child's name/event date) cannot be returned/exchanged/replaced at the customer's request.

Baby Furniture products that have been unsealed, assembled, or have damaged original packaging cannot be returned.

Products made to order, personalized according to the customer's specifications cannot be returned according to Ord.130/2000 Cap.2 Art.10, letter c) Contracts for the supply of products made according to the consumer's specifications or of distinctly personalized products, as well as those which, by their nature, cannot be returned or which may degrade or deteriorate quickly.

Consumer information:

Individuals have the right to withdraw from this contract, without giving any reason, within 14 calendar days. Legal entities cannot return the ordered products. The withdrawal period for natural persons expires after 14 days from the day of conclusion of the contract (from the day on which you or a third party other than the carrier indicated by you acquires physical possession of the products (in the case of a sales contract) or - from the day on which you or a third party other than the carrier indicated by you acquires physical possession of the last product (in the case of a contract for multiple goods ordered by the consumer in a single order and delivered separately) or - from the day on which you or a third party other than the carrier indicated by you acquires physical possession of the last batch or piece (in the case of a contract for the delivery of a product consisting of several batches or pieces) or - from the day on which you or a third party other than the carrier indicated by you acquire physical possession of the first product (in the case of a contract for the regular delivery of products over a specified period of time).

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement, for example, a letter sent by post or e-mail or by filling in the Google form attached to this page (click the button click here). For this purpose, you may use the attached withdrawal form; however, its use is not mandatory. If you use this option, we will send you without delay, on a durable medium, for example by e-mail/sms/telephone, confirmation of receipt of your withdrawal request.

To meet the withdrawal deadline, it is sufficient to send the communication at least 12 hours before the expiration of the withdrawal period. If you withdraw your order, we will refund any amount we have received from you, except for the costs of delivery (round trip).

Promotions

Promotions held on the Website www.camerabebelusului.ro are not cumulative with each other, the highest discount being applied. This applies to any form of discount (loyalty cards, promotional codes, gift vouchers, percentage discounts on the Website, etc.) as a rule, except in situations where it is otherwise stated in the promotion. Also, in the case of a percentage voucher, the holder of such a voucher cannot benefit from the cumulative discount conferred by applying the percentage voucher to the discount already existing within a promotion. Certain promotional campaigns are not cumulative with other discounts, promotions or loyalty actions. This is specified in the regulations of the respective campaign.

Contests + Newsletter Subscription

For participation in the contests organized by AnneBebe and partners, we will use your personal data (name, surname, email address, phone number, child's age, child's name). To register for the contests, you need to register with your email address, a means through which AnneBebe and the contest partners will be able to keep you informed of the contest results, promotional campaigns, information campaigns and news about the benefits of the AnneBebe Fan Club. Within each organized contest, a single prize is offered, which will be detailed on the contest page. • For physical prizes - products , the winner will present themselves for pickup at AnneBebe stores, if they are from Bucharest, or it will be delivered by express mail if they are in another city in Romania.
• For service prizes (photos, trainings) , the winner will choose a date/time when the partner is available to provide the service offered as a prize. The service will be provided only at the partner's location and only on the date and time agreed upon with them. Failure to show up without notifying them 48 hours in advance will result in the prize being forfeited!
