Baby Room Terms and Conditions of Use

All the information used to describe the PRODUCTS and/or SERVICES available on the SITE (static/dynamic images/multimedia presentations/etc.) do not represent a contractual obligation on the part of Camera Bebelusului, they are used exclusively for presentation purposes.

The promotions/offers present on the SITE are valid for a certain period of time and within the limit of available stock.

Access to place an ORDER is allowed to any CLIENT/USER.

For justified reasons, Camera Bebelusului reserves the right to restrict access to the CLIENT/USER in order to place an ORDER and/or to some of the accepted payment methods, if it considers that based on the behavior or activity of the CLIENT/USER on the SITE, the actions it could harm the Baby Room in any way. In any of these cases, the CLIENT/USER can contact the Baby Room Customer Support Department, to be informed about the reasons that led to the application of the aforementioned measures.

By placing an ORDER on the SITE, the CUSTOMER agrees to the form of communication (telephone or e-mail) through which Camera Bebelusului carries out its operations on the SITE.

Camera Bebelusului does not at any time consider an ORDER not confirmed by Camera Bebelusului as having the value of a CONTRACT.

The notification received by the CLIENT, immediately after placing the ORDER, has the role of information and does not represent the confirmation of the ORDER. This notification is made electronically (e-mail) or by telephone.

For justified reasons, Cama Bebelusului reserves the right to change the quantity of PRODUCTS and/or SERVICES in the ORDER. If we change the quantity of PRODUCTS and/or SERVICES in the ORDER, we will notify the CLIENT at the e-mail address or phone number provided to the Baby Room when placing the ORDER and we will return the amount paid.

The CONTRACT is considered concluded between the Baby Room and the CLIENT when the CLIENT receives the ORDER confirmation notification from the Baby Room, via e-mail and/or SMS. Therefore, the CONTRACT enters into force upon confirmation of the ORDER by the Baby Room.

For ORDERS to be picked up from the Camera Bebelusului store, the prices and reservations of the PRODUCTS and/or SERVICES are valid 72 (seventy-two) hours from the registration of the ORDER by the CUSTOMER.

The document and information made available by Camera Bebelusului on the SITE will form the basis of the CONTRACT thus concluded, supplemented by the Warranty Certificate issued by the suppliers of Camera Bebelusului.

The terms and conditions of use can be changed at any time by updating this SITE, these changes becoming mandatory and with immediate effect for all USERS/CLIENTS.

Command

The CLIENT/USER can place ORDERS on the SITE, by adding the desired PRODUCTS and/or SERVICES to the shopping cart, then finalizing the ORDER by paying through one of the methods expressly indicated. Once added to the shopping cart, a PRODUCT and/or a SERVICE is available for purchase as long as there is stock available for it. Adding a PRODUCT/SERVICE to the shopping cart, without completing the ORDER, does not entail the registration of the ORDER, implicitly neither the automatic reservation of the PRODUCT/SERVICE.


Important notice: Products brought to order (status: pre-order) or made to order/status: pre-order (not in stock according to the customer's specifications) CANNOT BE RETURNED. For these products it is necessary to pay an advance of at least 30%.
*the "Pre-order" status represents the status of a product or group of products for which the customer has the opportunity to place an order for that good or group of products, which is not in our company's stock and is brought especially for it after orders placed on the website, by phone or via whatsapp.

When receiving the order from the courier, please check the integrity of the package and check very carefully that the packaging is not damaged!
In the event that you notice SMALL degradation, bent corners or edges or the product is hit or cracked, please note on the AWB or on the VERBAL PROCESS of the courier "DAMAGED PACKAGING DURING TRANSPORT & DEFECTIVE PRODUCT".

Sign the AWB for receipt ONLY after you have made these observations on the AWB or on the Verbal Process!


By completing the ORDER, the CUSTOMER agrees that all the data provided by him, necessary for the online purchase process, are correct, complete and true on the date of placing the ORDER.

By completing the ORDER, the CLIENT agrees that Camera Bebelusului can contact him, by any means available/agreed by Camera Bebelusului, in any situation in which it is necessary to contact the CUSTOMER.

Camera Bebelusului can cancel the ORDER made by the CLIENT, following a prior notification addressed to the CLIENT, without any subsequent obligation of either party to the other or without any party being able to claim damages from the other in the following cases:

The price of products and services

All prices related to the PRODUCTS and/or SERVICES presented on the SITE are expressed in RON (RON) and include VAT

Under the conditions provided by law, the price of the electronic PRODUCTS displayed on the SITE includes the green stamp tax.

In the case of online payments, CameraBebelusului is not/cannot be held responsible for any other additional costs borne by the CLIENT, including but not limited to currency conversion fees applied by the issuing bank of his card, in the event that the issuing currency of it differs from RON. The CLIENT is solely responsible for this action.

The price can be changed by the Baby Room, at any time, without notice.

Camera Bebelusului points out that there are cases when, as a result of some malfunctions of the SITE or errors, the price displayed on the SITE may not be the real one. In these cases, the Baby Room will inform the CLIENT about the correct price.

The prices of the PRODUCTS on the SITE are not valid for the AnneBebe / Camera Bebelusului store network.

We inform you that camabebelusului.ro reserves the right to cancel Orders for Products and Services that are displayed on the site as a result of technical errors, or that, due to technical errors, present obviously erroneous/derisive prices for products (prices on which can be viewed as erroneous/derisive by any buyer).

Transfer of Product Ownership

Unless it is agreed by the Baby Room and a different CLIENT, the ownership of the PRODUCTS will be transferred upon delivery, after payment has been made by the CLIENT at the location indicated in the ORDER (understood by delivery - the signature of receipt of the transport document provided by to the Courier or the receipt signature on the tax invoice in the case of deliveries made in the Camera Bebelusului store).

The entire content of this site (data, images, texts, graphics, symbols, web graphic elements, scripts, programs and other data) is the property of ARTCONFEX SRL and is protected by copyright law, all rights being reserved. The use of any elements listed above without obtaining a prior agreement from the right holders is punishable according to the laws in force. The content of the website www.camerabebelusului.ro cannot be reproduced, modified, transferred, distributed, republished, copied or transmitted in any form, including electronic form, without the prior written permission of the representatives.

Any attempt to access the personal data of another user, to modify the content of the www.camerabebelusului.ro site or to affect the performance of the server on which the SCARTCONFEX.SRL site runs, will be considered an attempt to defraud the SCARTCONFEX IT systems. SRL and brings with it the criminal investigation against the one or those who try / have tried this fact.

The products sold by www.camerabebelusului.ro are new, in the original packaging of the manufacturer and at the time of delivery/delivery are accompanied by the tax invoice.

GUARANTEES

Commercial guarantee:

The commercial guarantee is according to the guarantee certificate issued by the manufacturer, depending on the product category and represents the period during which the consumer benefits from free repairs from the seller/producer.

For the products purchased from the online store www.camerabebelusului.ro, a warranty is provided in accordance with the Warranty Certificate related to each product or the legal warranty of compliance for 24 months from the purchase. In order to benefit from the guarantee, the Customer has the following obligations:

• the product must have been purchased from SC ARTCONFEX SRL and used only for the purpose for which it was designed;

• to respect the instructions for use and to use the product according to the instructions imposed by the manufacturer;

• to keep the warranty certificate and the fiscal document with which he bought the product;

The place of presentation to be able to benefit from the guarantee is the Camera Bebelusului Showroom - Str. Tombstones No. 6, Floor 1 behind the Unirea Shopping Center store - Overground Parking area, Bucharest, Sector 3, unless otherwise specified, the cost of transport is borne by the Customer.

Causes of loss of warranty:

• breakdowns or mechanical damage; excessive exposure to solar radiation; missing or changing the device series; product changes;

• damage caused as a result of non-compliance with the instructions for use, transport, handling and installation;

No guarantees are offered to Customers in the following cases:

• if the purchased product does not meet the requirements or expectations of the Customers;

• after the expiration of the period for which the Seller offers a product guarantee;

All other provisions included in the legislation in force, regarding the guarantee of the products sold, are valid. Clients' rights are those stipulated in the legislation in the field. The warranty does not extend to any damage caused by the use of the product

Your claims regarding the warranty are limited to the possibilities of eliminating defects in post-delivery conditions.

SCARTCONFEX.SRL does not guarantee and cannot be considered responsible for products that are not imported by our company, in case the delivered products do not correspond to the purpose for which they were purchased. The products (when applicable) are accompanied by warranty certificates of the respective manufacturers. Any complaint will be brought to our attention, in writing, to our address office@annebebe.ro, within a maximum of 48 hours from the receipt of the products, following which it will be sent to the supplier of the respective products.

Warranty of conformity

All products benefit, according to the law, from the guarantee of conformity, which represents the legal period of 2 years in which the consumer can bring the product into conformity free of charge. Conformity refers to the characteristics of the product offered to the consumer through the related advertising made by the seller/producer.

In the case of the compliance guarantee period, the manufacturer repairs, replaces or returns the product's counter value, according to Law 449/2003, Art 11, Paragraph 2. The time period established for remedying the repair cannot exceed 15 calendar days from the date on which the buyer brought to the knowledge of the seller about the lack of conformity of the product.

Notification of faults:

You have the obligation to transmit to SCARTCONFEX.SRL immediately and without delay, any damage noticed, especially damage caused during transport.

Payment and retention of the goods:

Until full payment of the order, this product remains the property of SCARTCONFEX.SRL

Responsibilities:

SCARTCONFEX.SRL is only responsible for damages that were not caused intentionally or negligently during transport.

SCARTCONFEX.SRL is not responsible for indirect damages.

Violation of our general conditions.
By violating our general conditions, SCARTCONFEX.SRL reserves the right to stop making deliveries to the customer and to terminate the contract with him.

Modification of the general conditions:

SCARTCONFEX.SRL reserves the right to modify these general conditions, without giving reasons, whenever it considers it necessary. The changes made do not apply to orders in progress. By placing an order, the general conditions in force are automatically accepted.

The problems not resolved amicably by the parties are under the jurisdiction of the common law courts in Romania.

Law no. 449/2003

Art. 19. - The guarantee is legally binding for the bidder, under the conditions specified in the declarations regarding the guarantee and in the related advertising.
Art. 20. - (1) The guarantee must include mentions regarding the rights conferred by law on the consumer and clearly certify that these rights are not affected by the guarantee offered.
(2) The warranty must specify the product identification elements, the warranty period, the average duration of use, the methods of ensuring the warranty - maintenance, repair, replacement and the deadline for their realization, including the name and address of the seller and the specialized unit of service.@
(3) The guarantee must be written in simple and easy-to-understand terms.
@Paragraph (2) was modified by art. I point 8 of GEO no. 174/2008.
Art. 21. - (1) At the request of the consumer, the guarantee will be offered in writing or on any other durable medium, available and accessible to him.
(2) If the guarantee does not comply with the provisions of para. (1) and of art. 20, its validity is not affected, the consumer having the right to ask the seller to fulfill the conditions included in the declarations regarding the guarantee.
Art. 22. - (1) Contract clauses or agreements concluded between the seller and the consumer before the lack of conformity is known to the consumer and communicated to the seller, which limit or remove, directly or indirectly, the rights of the consumer provided by this law, are void Right.
(2) In the case of used products, the consumer and the seller can agree to reduce the term provided for in art. 16, but not less than one year from the date of delivery of the product.

Right of Withdrawal

According to the legislation in force, the CLIENT can exercise the right to withdraw from the CONTRACT within 14 (fourteen) CALENDAR days after taking possession of the PRODUCTS.

If the CLIENT requests withdrawal from the CONTRACT within the legal term, if the ORDER is paid, Camera Bebelusului will reimburse the amount within a maximum of 14 (fourteen) CALENDAR days from the date of informing the store Camera Bebelusului by the CLIENT about his decision to withdraw from the CONTRACT.

The amount will be returned for ORDERS paid with OP / COD / Bank card-> ONLY by bank transfer.

For orders that were fully or partially paid with a gift card / gift voucher, the money can NOT be returned, the Voucher / Gift Card will be re-issued and can be used within a maximum of 6 months from the date of the first issue.


The CameraBebelusului.ro store will be able to postpone the refund of the amount until the receipt of the sold PRODUCTS or until the receipt of proof that they have been shipped, in case it has not offered to recover the PRODUCTS itself (the most recent date will be taken).

The CameraBebelusului.ro store reserves the right to reduce the amounts reimbursed to the CLIENT by the value resulting from the manipulation of the PRODUCTS, other than those necessary to determine the nature, characteristics and functionality of the PRODUCTS.

The following are excluded from the right of withdrawal from the CONTRACT:

service contracts, after the full performance of the services, if the execution has started with the prior express consent of the CLIENT and after he has confirmed that he has become aware of the fact that he will lose his right to withdraw after the full execution of the CONTRACT by the CameraBebelusului Store .ro or its suppliers;

the supply of PRODUCTS ORDERED BY THE CLIENT or CONFECTED according to the specifications presented by the CLIENT or clearly customized;

providing PRODUCTS that are likely to deteriorate or expire quickly;

the supply of sealed PRODUCTS that cannot be returned for health protection or hygiene reasons and that have been unsealed by the CUSTOMER (PRODUCTS THAT COME INTO CONTACT WITH THE SKIN OF BABIES);

contracts in which the CLIENT specifically requested the CameraBebelusului.ro Store or its suppliers to move to his home to carry out urgent repair or maintenance work. If, on the occasion of such a visit, CameraBebelusului.ro or its suppliers provide other services apart from those expressly requested by the CLIENT or supply other PRODUCTS than the spare parts indispensable for the execution of maintenance or repair works, the right of withdrawal apply to those additional SERVICES or PRODUCTS;
If the customer receives the order, removes the product from the original box and damages the original packaging and the product, the ordered products will NOT be able to be returned!
If the customer sends back the order, it will be ensured that it arrives with the packaging of the product undamaged, so that it can be resold! Otherwise, the return of the products will not be accepted!
In the case of a return, the customer requesting the return of the product will make sure that the product has all the accessories, has all the original elements and that it has no scratches, deformations or damage after unpacking. SC ARTCONFEX SRL does not accept returns of products that are not in their original intact packaging and/or with labels, plastic or other missing elements.
Products that show signs of wear, use, damage will not be able to be returned!
Products without the original labels attached from the factory cannot be returned!

For products delivered with the security tag/seal mounted upon delivery, which are returned with the security seal/tag detached/torn by the customer, Return/exchange is not accepted, and after inspection the products will be delivered to the customer at his expense at an additional cost of 45 lei (round trip).

According to the Emergency Ordinance No. 34/2014 regarding consumer rights in distance contracts: The consumer has the right to withdraw from the distance contract, without having to justify the decision to withdraw and without incurring other costs than those provided for in art. 13 para. ( 3) and art. 14 of GEO No. 34/2014, within 14 calendar days starting from the day on which he takes physical possession of the product. Return costs are borne by you.

The returned product must be in the same condition in which it was delivered with all accessories.

For reasons of hygiene, SC ARTCONFEX SRL does not accept returns of underwear, leggings, diapers, socks, mattresses, bed protectors, bodysuits, maternity sets and in general any kind of products that can affect personal hygiene.


Products Personalized with Texts or Illustrations (eg: Christening products that are personalized with the child's name / date of the event) at the customer's request cannot be returned / changed / replaced.

Furniture products for babies that have been unsealed, assembled, have damaged original packaging CANNOT be returned.

Products made to order, customized according to the customer's specifications cannot be returned according to Ord. 130/2000 Chapter 2 Art. 10, letter c) Contracts for the supply of products made according to the customer's specifications or of distinctly customized products, as well as those which, by their nature, cannot be returned or which can degrade or deteriorate quickly;

Information for consumers Individuals have the right to withdraw from this contract, without specifying the reasons, within 14 calendar days. Legal entities cannot return ordered products. The withdrawal period for natural persons expires after 14 days starting from the day of conclusion of the contract (from the day on which you or a third party, other than the carrier, indicated by you, enters into physical possession of the products (in the case of a sales contract )or - from the day on which you or a third party, other than the carrier, indicated by you, enters into physical possession of the last product (in the case of a contract regarding multiple goods ordered by the consumer in a single order and delivered separately ) or - from the day on which you or a third party, other than the carrier, indicated by you, enters into physical possession of the last lot or the last part (in the case of a contract regarding the delivery of a product consisting of several lots or parties) or - from the day on which you or a third party, other than the carrier, indicated by you, take physical possession of the first product (in the case of a contract for the periodic delivery of products for a specified period of time)
To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract, using an unequivocal statement, for example, a letter sent by post or e-mail or filling in the google form attached to this page (click the click here button). For this purpose, you can use the attached withdrawal model; however, its use is not mandatory. If you use this option, we will send you confirmation of receipt of the withdrawal request without delay, on a durable medium, for example by e-mail/sms/telephone.
To meet the withdrawal deadline, it is enough to send the communication at least 12 hours before the withdrawal period expires. If you withdraw your order, we will refund any amount we have received from you, excluding the costs of delivery (round trip).

Promotions

The promotions carried out on the www.camerabebelusului.ro website are not cumulative, the biggest discount is applied. This is valid for any form of discount (loyalty cards, promotional codes, gift vouchers, percentage discounts on the Site, etc.) as a rule, with the exception of situations where it is mentioned otherwise in the promotion. Also, in the case of the existence of a percentage voucher, the holder of such a voucher cannot benefit from the cumulative discount conferred by the application of the percentage voucher to the already existing discount within a promotion. Certain promotional campaigns cannot be combined with other discounts, promotions or loyalty actions. This is specified in the regulations of the respective campaign.

Contests + Subscription to the Newsletter

To participate in the contests organized by AnneBebe and partners, we will use your personal data (name, surname, email address, phone number, child's age, child's name). To register for contests, you need to register with your e-mail address, a means by which AnneBebe and the partners in the contest will be able to keep you up to date with the contest results, promotional campaigns, informational campaigns and news about the benefits of the AnneBebe Fan Club. The details about the confidentiality policy and how we manage the newsletters can be found on the camerabebelusului.ro/confidentialitate page. Within each organized contest, only one prize is offered, which will be detailed on the contest page. In the first 1-3 days, at the end of the registration period displayed on the contest page, the winner will be drawn through the Random.org website and will be notified by email, to be able to take possession of the prize or to be scheduled, depending for each individual situation.

- For the physical prizes - products, the winner will present himself for collection in AnneBebe stores, if he is from Bucharest, or it will be delivered by express mail if he is in another city in Romania.

- For the service prizes (photo, trainings), the winner will choose a date/time when the partner is available to provide the service offered as a prize. The service will be provided only at the partner's location and only on the date and time agreed with him. Failure to show up without notifying him 48 hours before, will result in the loss of the prize!
