Baby Room Terms and Conditions of Use

All the information used to describe the PRODUCTS and/or SERVICES available on the SITE (static/dynamic images/multimedia presentations/etc.) do not represent a contractual obligation on the part of Camera Bebelusului, they are used exclusively for presentation purposes.

The promotions/offers present on the SITE are valid for a certain period of time and within the limit of available stock.

Access to place an ORDER is allowed to any CUSTOMER/USER.

For justified reasons , Camera Bebelusului reserves the right to restrict access to the CUSTOMER/USER in order to place an ORDER and/or to some of the accepted payment methods, if it considers that based on the behavior or activity of the CUSTOMER/USER on the SITE, his actions could harm the Baby Room in any way. In any of these cases, the CLIENT/USER can contact the Customer Support Department of Camera Bebelusului, to be informed about the reasons that led to the application of the above-mentioned measures.

By placing an ORDER on the SITE , the CUSTOMER agrees to the form of communication (telephone or e-mail) through which Camera Bebelusului conducts its operations on the SITE.

Camera Bebelusului does not at any time consider an ORDER not confirmed by Camera Bebelusului as having the value of a CONTRACT.

The notification received by the CLIENT , immediately after placing the ORDER, has the role of information and does not represent the confirmation of the ORDER. This notification is made electronically (e-mail) or by telephone.

For justified reasons , Camera Bebelusului reserves the right to change the quantity of PRODUCTS and/or SERVICES in the ORDER. If we change the quantity of PRODUCTS and/or SERVICES in the ORDER, we will notify the CLIENT at the email address or phone number provided to Camera Bebelusului when placing the ORDER and we will return the amount paid.

The CONTRACT is considered concluded between the Baby Room and the CLIENT at the moment the CLIENT receives the ORDER confirmation notification from the Baby Room, via e-mail and/or SMS. Therefore, the CONTRACT enters into force upon confirmation of the ORDER by the Baby Room.

For ORDERS to be picked up from the Camera Bebelusului store, the prices and reservations of the PRODUCTS and/or SERVICES are valid 72 (seventy-two) hours from the registration of the ORDER by the CUSTOMER.

The document and information made available by Camera Bebelusului on the WEBSITE will form the basis of the CONTRACT thus concluded, supplemented by the Certificate of Guarantee issued by the suppliers of Camera Bebelusului.

The terms and conditions of use can be changed at any time by updating this SITE, these changes becoming mandatory and with immediate effect for all USERS/CLIENTS.

Command

The CLIENT/USER can place ORDERS on the SITE , by adding the desired PRODUCTS and/or SERVICES to the shopping cart, then finalizing the ORDER by paying through one of the expressly indicated methods. Once added to the shopping cart, a PRODUCT and/or SERVICE is available for purchase subject to availability of stock. Adding a PRODUCT/SERVICE to the shopping cart, without completing the ORDER, does not result in the registration of the ORDER, implicitly nor the automatic reservation of the PRODUCT/SERVICE.

Important announcement

Products brought to order (status: pre-order) or made to order/status: pre-order (not in stock according to customer specifications) CANNOT BE RETURNED . A minimum 30% advance payment is required for these products.

The "Pre-order" status represents the status of a product or group of products for which the customer has the opportunity to place an order for that good or group of products, which is not in our company's stock and is brought specifically for him following the order placed on the website , by phone or via whatsapp.

When receiving the order from the courier , please check the integrity of the package and check very carefully that the packaging is not damaged!

In the event that you find minor degradation, bent corners or edges, or the product is bumped or cracked, please note on the AWB or the courier's RECORD "PACKAGING DAMAGED IN TRANSIT & PRODUCT DEFECTIVE".

Sign the AWB for receipt only after making these observations on the AWB or Minutes!

By completing the ORDER , the CUSTOMER agrees that all the data provided by him, necessary for the online purchase process, are correct, complete and true on the date of placing the ORDER.

By completing the ORDER , the CLIENT agrees that Camera Bebelusului can contact him, by any means available/agreed by Camera Bebelusului, in any situation where it is necessary to contact the CUSTOMER.

Camera Bebelusului can cancel the ORDER made by the CLIENT, following a prior notification addressed to the CLIENT, without any subsequent obligation of either party to the other or without any party being able to claim damages to the other in the following cases:

Price of products and services

All prices related to the PRODUCTS and/or SERVICES presented on the SITE are expressed in RON (RON) and include VAT

Under the conditions provided by law, the price of the electronic PRODUCTS displayed on the SITE includes the green stamp tax.

In the case of online payments, CameraBebelusului is not/cannot be held responsible for any other additional costs incurred by the CLIENT, including but not limited to currency conversion fees applied by the issuing bank of his card, in the event that the issuing currency of it differs from RON. Responsibility for this action rests solely with the CUSTOMER.

The price may be changed by the Baby Room at any time without notice.

Camera Bebelusului points out that there are cases when, as a result of SITE malfunctions or errors, the price displayed on the SITE may not be the real one. In these cases, Camera Bebelusului will inform the CUSTOMER of the correct price.

The prices of the PRODUCTS on the SITE are not valid for the AnneBebe / Camera Bebelusului store network.

We inform you that camabebelusului.ro reserves the right to cancel Orders for Products and Services that are displayed on the site as a result of technical errors, or that, due to technical errors, present obviously erroneous/derisive prices for the products (prices that any buyer may consider as erroneous/derisory).

Transfer of Product Ownership

Unless otherwise agreed by the Baby Room and the CLIENT, the ownership of the PRODUCTS will be transferred upon delivery, after payment has been made by the CLIENT at the location indicated in the ORDER (understanding by delivery – the signature of receipt of the transport document provided by to the Courier or the receipt signature on the tax invoice in the case of deliveries made in the Camera Bebelusului store).

The entire content of this site (data, images, texts, graphics, symbols, web graphic elements, scripts, programs and other data) is the property of ARTCONFEX SRL and is protected by copyright law, all rights being reserved. The use of any elements listed above without obtaining prior consent from the right holders is punishable according to the laws in force. The content of the website www.camerabebelusului.ro may not be reproduced, modified, transferred, distributed, republished, copied or transmitted in any form, including electronic form, without the prior written permission of the representatives.

GUARANTEES

Commercial guarantee:

The commercial warranty is according to the warranty certificate issued by the manufacturer, depending on the product category, and represents the period during which the consumer benefits from free repairs from the seller/manufacturer.

For the products purchased from the online store www.camerabebelusului.ro, a warranty is provided in accordance with the Warranty Certificate related to each product or the legal warranty of compliance for 24 months from the purchase. To benefit from the warranty

• The product must have been purchased from SC ARTCONFEX SRL and used only for the purpose for which it was designed.
• Follow the instructions for use and use the product according to the manufacturer's instructions.
• To keep the warranty certificate and the tax document with which he bought the product.

The place of presentation to be able to benefit from the guarantee is the Camera Bebelusului Showroom - Str. Tombstones No. 6, Floor 1, behind the Unirea Shopping Center store - Overground Parking area, Bucharest, Sector 3. Unless otherwise specified, the cost of transport is borne by the Customer.

Causes of loss of warranty:

• Breakdowns or mechanical damage; excessive exposure to solar radiation; missing or changing the device series; product changes.
• Defect produced as a result of non-observance of instructions for use, transport, handling and installation.

No guarantees are offered to Customers in the following cases:

• If the purchased product does not meet the requirements or expectations of the Customers.
• After the expiration of the period for which the Seller guarantees the product.

All other provisions contained in the legislation in force, regarding the guarantee of the products sold, are valid. Clients' rights are those provided for in the legislation in the field. The warranty does not extend to any damage caused by the use of the product.

Your warranty claims are limited to the possibilities of eliminating defects under post-delivery conditions.

SC ARTCONFEX SRL does not guarantee and cannot be held responsible for products that are not imported by our company, if the delivered products do not correspond to the purpose for which they were purchased. The products (when applicable) are accompanied by warranty certificates from the respective manufacturers. Any complaint will be brought to our attention, in writing, to our address office@annebebe.ro , within a maximum of 48 hours after receiving the products, and it will then be forwarded to the supplier of the respective products.

Warranty of conformity

All products benefit, according to the law, from the conformity guarantee which represents the legal period of 2 years in which the consumer can bring the product into conformity free of charge. Conformity refers to the characteristics of the product offered to the consumer through the related advertising made by the seller/manufacturer.

In the case of the compliance guarantee term, the manufacturer repairs, replaces or refunds the product's value, according to Law 449/2003, Art 11, Paragraph 2. The time period established for remedying the repair cannot exceed 15 calendar days from the date on which the buyer brought to the seller's attention the lack of conformity of the product.

Notification of faults:

You have the obligation to send to SC ARTCONFEX SRL immediately and without delay, any damage noticed, especially damage caused during transport.

Payment and retention of the goods:

Until full payment of the order, this product remains the property of SC ARTCONFEX SRL

responsibility

SC ARTCONFEX SRL is only responsible for damages that were not caused intentionally or negligently during transport.

SC ARTCONFEX SRL is not responsible for indirect damages.

Violation of our terms and conditions:

By violating our general conditions, SC ARTCONFEX SRL reserves the right to stop making deliveries to the customer and to terminate the contract with him.

Modification of the general conditions:

SC ARTCONFEX SRL reserves the right to modify these general conditions, without giving reasons, whenever it considers it necessary. Changes made do not apply to orders in progress. By placing an order, the general conditions in force are automatically accepted.

Law no. 449/2003

Art. 19. - The guarantee is legally binding for the bidder, under the conditions specified in the declarations regarding the guarantee and in the related advertising.

Art. 20. - (1) The guarantee must include mentions of the rights conferred by law on the consumer and clearly certify that these rights are not affected by the guarantee offered.

(2) The guarantee must specify the product identification elements, the guarantee term, the average duration of use, the methods of ensuring the guarantee - maintenance, repair, replacement and the deadline for their realization, including the name and address of the seller and the specialized unit of service.

(3) The guarantee must be written in simple and easy-to-understand terms.

Art. 21. - (1) At the request of the consumer, the guarantee will be provided in writing or on any other durable medium, available and accessible to him.

(2) If the guarantee does not comply with the provisions of para. (1) and of art. 20, its validity is not affected, the consumer having the right to ask the seller to fulfill the conditions included in the warranty statements.

Art. 22. - (1) Contract clauses or agreements concluded between the seller and the consumer before the lack of conformity is known to the consumer and communicated to the seller, which limit or remove, directly or indirectly, the rights of the consumer provided by this law, are void justice.

(2) In the case of used products, the consumer and the seller can agree to reduce the term provided for in art. 16, but not less than one year from the date of delivery of the product.

Right of Withdrawal

According to the legislation in force, the CLIENT can exercise his right of withdrawal from the CONTRACT within 14 (fourteen) CALENDAR days after taking possession of the PRODUCTS.

If the CLIENT requests withdrawal from the CONTRACT within the legal term, if the ORDER is paid, Camera Bebelusului will reimburse the amount within a maximum of 14 (fourteen) CALENDAR days from the date of informing the store Camera Bebelusului by the CLIENT of his decision to withdraw from the CONTRACT.

The amount will be returned for ORDERS paid with OP / COD / Bank card -> ONLY by bank transfer.

For orders that were fully or partially paid with a gift card / gift voucher, the money can NOT be returned, the Voucher / Gift Card will be reissued and can be used within a maximum of 6 months from the date of first issue.

The CameraBebelusului.ro store will be able to delay refunding the amount until receipt of the sold PRODUCTS or until receipt of proof that they have been shipped, if it has not offered to retrieve the PRODUCTS itself (the latest date will be taken).

The CameraBebelusului.ro store reserves the right to reduce the amounts reimbursed to the CUSTOMER by the value resulting from the handling of the PRODUCTS, other than those necessary to determine the nature, characteristics and functionality of the PRODUCTS.

The following are excluded from the right of withdrawal from the CONTRACT:

• Service contracts, after the full performance of the services, if the execution has begun with the express prior consent of the CLIENT and after he has confirmed that he has become aware of the fact that he will lose his right of withdrawal after the full execution of the CONTRACT by the CameraBebelusului Store .ro or its suppliers.
• Supply of CUSTOMER-ORDERED or CONFECTED PRODUCTS according to the specifications presented by the CUSTOMER or clearly customized.
• Providing PRODUCTS that are likely to deteriorate or expire quickly.
• Supply of sealed PRODUCTS that cannot be returned for health protection or hygiene reasons and that have been unsealed by the consumer, according to Emergency Ordinance no. 34/2014 regarding consumer rights in contracts concluded with professionals, Article 16, point e). The products that are part of this category are: Underwear, leggings, tights, socks, mattresses, bed protectors, bed linen, towels, cloths, textile diapers , sanitary napkins, bodysuits, maternity sets and all their derivatives , to ensure the safety and hygiene of the products sold, avoiding the risk of contamination of articles intended for babies.
• Contracts in case the CLIENT has specifically requested the CameraBebelusului.ro Store or its suppliers to move to his home to carry out urgent repair or maintenance work. If, on the occasion of such a visit, CameraBebelusului.ro or its suppliers provide other services other than those expressly requested by the CLIENT or provide other PRODUCTS than the spare parts indispensable for the execution of maintenance or repair work, the right of withdrawal applies to those additional SERVICES or PRODUCTS.

If the customer receives the order, removes the product from the original box and damages the original packaging and the product, the ordered products will NOT be able to be returned!

If the customer sends back the order, he will ensure that it arrives with the product packaging undamaged, so that it can be resold! Otherwise, the return of the products will not be accepted!

In the case of a return, the customer requesting the return of the product will ensure that the product has all accessories, has all the original elements and that it has no scratches, deformations or damages following unpacking. SC ARTCONFEX SRL does not accept returns of products that are not in their original packaging intact and/or with missing labels, plastics or other elements.

Products that show signs of wear, use, damage will not be able to be returned!

Products without the original tags attached from the factory will not be able to be returned!

For products delivered with the security tag/seal fitted on delivery, which is returned with the security seal/tag detached/torn by the customer, no return/exchange is accepted and after inspection the products will be delivered to the customer at the customer's expense at an additional cost of 45 lei (round trip).

According to Emergency Ordinance No. 34/2014 regarding consumer rights in distance contracts: The consumer has the right to withdraw from the distance contract, without having to justify the withdrawal decision and without incurring other costs than those provided for in art. 13 para. (3) and art. 14 of GEO No. 34/2014, within 14 calendar days starting from the day they take physical possession of the product. Return costs are borne by you.

The returned product must be in the same condition as it was delivered with all accessories.

For reasons of hygiene, SC ARTCONFEX SRL does not accept returns for unsealed products that may endanger the lives of babies. Products cannot be returned for reasons of health protection or for reasons of hygiene and that have been unsealed by the consumer are exempt from the right of withdrawal, according to Emergency Ordinance no. 34/2014 regarding consumer rights in contracts concluded with professionals, Article 16, point e). The products that are part of this category are: Underwear, leggings, tights, socks, mattresses, bed protectors, bed linen, towels, cloths, muslins, sanitary napkins, bodysuits, maternity sets and all their derivatives, to ensure the safety and hygiene of the products sold, avoiding the risk of contamination of baby items.

Products Personalized with Texts or Illustrations (eg: Christening products that are personalized with the child's name/date of the event) at the customer's request cannot be returned/exchanged/replaced.

Baby Furniture products that have been unsealed, assembled, have damaged original packaging are NOT returnable.

Products made to order, customized according to the customer's specifications cannot be returned according to Ord. 130/2000 Chapter 2 Art. 10, letter c) Contracts for the supply of products made according to the customer's specifications or distinctly customized products, as well as those which, by their nature, cannot be returned or which can degrade or deteriorate quickly.

Information for consumers:

Individuals have the right to withdraw from this contract, without specifying the reasons, within 14 calendar days. Legal entities cannot return ordered products. The withdrawal period for natural persons expires after 14 days starting from the day of conclusion of the contract (from the day on which you or a third party, other than the carrier, indicated by you, enters into physical possession of the products (in the case of a sales contract ) or - from the day on which you or a third party, other than the carrier, indicated by you, enters into physical possession of the last product (in the case of a contract regarding multiple goods ordered by the consumer in a single order and delivered separately ) or - from the day on which you or a third party, other than the carrier, indicated by you, enters into physical possession of the last lot or the last piece (in the case of a contract for the delivery of a product consisting of several lots or parties) or - from the day on which you or a third party, other than the carrier, indicated by you, take physical possession of the first product (in the case of a contract for the periodic delivery of products for a specified period of time) .

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract using an unequivocal statement, for example, a letter sent by post or email or by filling in the Google form attached to this page ( press the click here button). For this purpose, you can use the attached withdrawal model; however, its use is not mandatory. If you use this option, we will send you, without delay, on a durable medium, for example by e-mail/sms/telephone, confirmation of receipt of the withdrawal request.

To meet the withdrawal deadline, it is sufficient to send the communication at least 12 hours before the withdrawal period expires. If you withdraw your order, we will refund any amount we have received from you, excluding the costs of delivery (round trip).

Promotions

The promotions carried out on the www.camerabebelusului.ro website are not cumulative, the biggest discount is applied. This applies to any form of discount (loyalty cards, promotional codes, gift vouchers, percentage discounts on the Site, etc.) as a rule, except where otherwise stated in the promotion. Also, in the case of the existence of a percentage voucher, the holder of such a voucher cannot benefit from the cumulative discount conferred by the application of the percentage voucher to the already existing discount within a promotion.
